These Terms of Service (“Terms”) govern your use of 2hearted (the “Service”), operated by ELMMLY LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

Acceptance of Terms

By accessing or using 2hearted, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

Account Eligibility

You must be at least 18 years old to use 2hearted. By creating an account, you represent that you are 18 or older and that the information you provide is accurate.

AI-Generated Content Disclaimer

2hearted provides AI-generated suggestions for date planning, personality profiling, and relationship enrichment. These suggestions are not professional relationship counseling, therapy, or medical advice.

  • AI-generated personality profiles are based on pattern recognition and may not fully capture the nuances of your personality or relationship.
  • Date suggestions are based on stated preferences and may not account for all real-world factors.
  • Compatibility insights are informational only and should not be used as a basis for major relationship decisions.

If you are experiencing relationship difficulties, please consult a licensed professional counselor or therapist. 2hearted is a date planning and enrichment tool, not a substitute for professional guidance.

Limitation of Liability

To the maximum extent permitted by law:

  • ELMMLY LLC is not liable for any decisions you make based on AI-generated recommendations.
  • The Service is provided “as is” without warranties of any kind, express or implied.
  • ELMMLY LLC’s total liability for any claims arising from your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim (currently $0, as the Service is free).
  • ELMMLY LLC is not liable for indirect, incidental, special, consequential, or punitive damages.

User Responsibilities

When using 2hearted, you agree to:

  • Provide accurate information in your profile and assessments.
  • Use the Service respectfully and in good faith.
  • Not use the Service to harass, abuse, or harm others.
  • Not attempt to reverse-engineer, decompile, or extract the AI models or algorithms.
  • Not create multiple accounts or share account credentials.
  • Not use the Service for any unlawful purpose.

Data Ownership

  • Your data belongs to you. You retain ownership of all personal information and content you provide to 2hearted.
  • Processing license: By using the Service, you grant ELMMLY LLC a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Service.
  • AI Training: We will only use your data to train or improve AI models if you explicitly grant AI Training consent. This consent is OFF by default.

Termination and Data Deletion

  • By you: You may delete your account at any time through Settings. Account deletion enters a 30-day grace period during which you can cancel. After the grace period, all personal data is permanently deleted.
  • By us: We may suspend or terminate your account if you violate these Terms. We will provide notice and an opportunity to export your data before permanent deletion, except in cases of severe violations.
  • Data export: You can request a full export of your data at any time before account deletion.

Governing Law

These Terms are governed by the laws of the state in which ELMMLY LLC is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved in the courts of that jurisdiction.

Modifications to Terms

We may modify these Terms from time to time. Material changes will be communicated with at least 30 days’ notice. For material changes that affect your rights or obligations, we will require re-acknowledgment before you can continue using the Service.

Your continued use of the Service after the notice period constitutes acceptance of the updated Terms.
